“I GOTCHA’ NOW, JIM.  IT’S OVER, JIM.”  According to court testimony today, those are the words spoken by Nicholas Gianquitti right after he shot Cranston Fire Lieutenant James Pagano in the chest in front of a group of children attending a birthday party for Pagano’s son.

Gianquitti has been held on murder charges since then and today his bail hearing was held.  The prosecution has presented five witnesses including his father and his nephew.  As so often happens, the early news reports differed from what today’s testimony brought out.

According to Ch. 6:

James Pagano’s 12-year old nephew said that he and his friends were playing a pick-up baseball game in the street when the tennis ball they were using got away and hit Gianquitti’s car.

 He said Gianquitti went into a profanity-laced tirade, telling the boys to take their game down the street. 

According to the testimony of James Pagano’s father Anthony, his son then went over to Gianquitti’s to confront him.  Anthony Pagano said his son took a swing at Gianquitti, who then pulled out a gun and shot James Pagano. 

The hearing was not completed today and will resume at 2 pm tomorrow.
